Waypoint America LLC dba Govology (“We,” “GOVOLOGY”) respects Your rights regarding Your privacy and Your ‘Personally Identifiable Information’ (PII), and we are committed to ensuring the security of your personal information. We provide this Privacy Policy to help You understand how We collect, use, share, store, and disclose information We obtain from or about You when You use GOVOLOGY’s website (Our “Website”) and various third-party platforms (“Third-Party Platforms”) that We use to host courses, deliver webinars, provide coaching, hold virtual meetings, provide technical support, collect feedback, and process transactions. 

By using our Services, you consent to the collection, use, and processing of your personal information as described in this Policy.

Definitions

“PII,” as described in US privacy law and information security, is information that can be used on its own or with other information to identify, contact, or locate a single person or to identify an individual in context. 

“Use” shall mean use, access, install, sign into, connect with, download, visit, or browse Our Website and Third-Party Platforms. 

“Services” refers to GOVOLOGY webinars, on-demand courses, coaching, cohorts, and other offerings. Additionally, any information related to taking courses, including, without limitation, interchanges with instructors (“Instructors”), other users (“Users”), feed posts, assignments, and other items submitted to satisfy the course requirements, is referred to as “Course Information.” 

Scope

This Privacy Policy applies to information We collect online through Your use of Our Services. If You use Our Services on or through a Third-Party Platform, including via any Wireless Devices, Your privacy will also be subject to the privacy policies and terms of service of the Third-Party Platform.

We do not control and are not responsible for the terms of service, privacy policies, and/or practices of any Third-Party Platform You may use to access Our Services, and You should review the policies and agreements of such Third-Party Platforms carefully.

Policy Guidelines

1. The Type of Information We May Collect

1.1. Account Information. When You sign up for Our Services (including through a Third-Party Platform), We will collect any information You provide to Us directly, such as the following:

(a) Registration Information. In order to use certain features of Our Services, such as purchasing a course, registering for a webinar, or enrolling in a cohort, You are required to register for an Account on Our Website. In that case, We will collect and store any registration information You share with Us, such as Your e-mail address, username, password, address, and other information. 

If You are a small business, We will also collect socio-economic information about Your company and Your small business status. We share this information with Our collaborative partners, such as APEX Accelerators (formerly Procurement Technical Assistance Centers), Small Business Development Centers (SBDCs), Veteran Business Outreach Centers (VBOCs), and the like. Our partners use this information to measure the impact of their programs in their local communities and to report to their funding authorities, such as the Department of Defense Office of Small Business Programs and the U.S. Small Business Administration. We also proactively look for government grants and other sources of funding to cover the cost of training for Our Users who cannot afford to pay for it. Hence, We may use Your company information to compile an aggregate report and share it with government agencies and other funding partners. 

You hereby consent to GOVOLOGY providing Registration Information to Our collaborative partners. You also consent to GOVOLOGY reporting Your company data as part of an aggregate report to government agencies and other funding partners. 

(b) Profile Information. You may also have the option of providing additional information about Yourself (“Profile Information”) to create a User profile (“Profile”) that will be publicly viewable by others. You should exercise care and caution in creating Your Profile, as other Users will be able to view Your Profile, including Your Profile Information. GOVOLOGY is not responsible for the information You supply in Your Profile and/or the manner in which it is used by others.

1.2. Public Posting / Shared Content. Some of Our Services may allow You to interact with other Users and/or post, share, communicate, or otherwise transmit content publicly, such as posting comments or asking questions in cohorts, sending messages to or chatting with other Users (collectively, “Shared Content” or “Public Posting”). We may collect and store archives of such Public Postings on GOVOLOGY’s servers. All Public Postings are subject to this Privacy Policy and may be used or disclosed pursuant to the terms of this Privacy Policy and the Terms of Use, including but not limited to protecting the safety and well-being of members of the public, minors, Our Users, Our employees, and Our Services.

1.3. Webinar Feedback and Course Reviews. At the end of each webinar, We send a survey to webinar attendees requesting their feedback (“Feedback”) and asking them to post a review (“Review”) on Our Website. If You provide Feedback and/or post a Review, We may use them to market Our Services. You hereby grant GOVOLOGY a non-exclusive right and license to reproduce, distribute, publicly perform, offer, market, and otherwise use Your Feedback and Reviews.

1.4. Payment Information. If You make any purchases through Our Website, We collect certain information regarding Your purchase (such as Your name and contact information) as necessary to process Your order. You are also required to provide certain payment and billing information directly to Our payment processing partners (currently PayPal and Stripe), including but not limited to Your name, credit card information, billing address, and zip code. We do not directly access, store, or collect Your credit card information. All direct payment gateways like Stripe adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express, and Discover. PCI-DSS requirements help ensure the secure handling of credit card information.

We will not use the payment information We collect except as needed to fulfill Your purchase and/or communicate with You regarding Your transaction.

1.5 Communications, Support Requests, Potential Abuse. If You contact Us for assistance or to report a problem, concern, potential abuse, or other issues regarding Our Services or other Users, We may collect and store Your contact information, communication, and other information about You, including but not limited to Your name, e-mail address, location, operating system, IP address or activity. We reserve the right to conduct further research and obtain additional information as necessary. We will use the information to respond to You and research Your request/communication, all in accordance with the provisions of this Privacy Policy.

1.6 Sweepstakes, Promotions, and Surveys. From time to time, We may ask You to complete a survey and/or offer You the opportunity to participate in promotions via Our Website or through a Third-Party Platform. If You choose to participate in a promotion, We will collect and store the information You provide in connection with Your participation in the promotion, such as Your name, e-mail address, phone number, and whatever other information You provide. We will use and/or disclose that information in accordance with this Privacy Policy unless stated otherwise, such as in the official rules (or other guidelines) of the promotion or as stated in another privacy policy that may govern the promotion. 

All of Our promotions will have official rules or guidelines outlining what information is collected. The information You provide as part of Your participation in the promotion will be used to administer the promotion, such as to contact You for winner notification, prize delivery confirmation, or other related purposes in accordance with this Privacy Policy. In addition, if You win a contest or sweepstakes, Your acceptance of the prize may require You (unless prohibited by law) to allow Us to post some of Your information publicly via Our Website and Third-Party Platforms, such as Facebook and LinkedIn. 

Also, by agreeing to participate in Our promotions, You give us permission to add You to Our mailing list for marketing purposes. If You do not want to receive promotional offers from Us, You can easily opt out from future promotions by unsubscribing from the list. We respect Your wishes and always add the “unsubscribe” link in all Our communications. 

Sometimes, Our Instructors and partners may sponsor a promotion on Our Website and collect Your information if You choose to participate. In those cases where We are not the sponsor or operator of the promotion, We have no control over the information collected. You should review the official rules and the sponsor’s privacy policy applicable to the promotion before participating.

1.7. Technical and Usage Information We Collect Through Automated Means. Like many websites and app providers, GOVOLOGY (and/or service providers acting on Our behalf, such as Google Analytics) uses automated data collection tools, such as cookies, tags, scripts, and web beacons (collectively, “Data Collection Tools”) when You access and use Our Website. “Cookies” are small files that websites send to Your computer or Wireless Device to uniquely identify Your browser or mobile device or to store information in Your browser setting. “Web Beacons” are a technique that allows Us to measure the actions of visitors using Our Website. These Data Collection Tools automatically track and collect certain technical information that Your browser sends when You use Our Website, such as Your IP address, browser type, browser language, referring and exit pages, URLs, platform type, the number of clicks, domain names, landing pages, clickstream data, pages viewed and the order of those pages, the amount of time spent on particular pages, and the date and time of activity using Our Website, and other similar information (collectively “Technical Information”). 

The technical information We obtain is collected, used, and stored as aggregated information (“Aggregate Information”), which may be used for several purposes, including to improve the quality of Our Website, evaluate the effectiveness and popularity of certain Content, track the effectiveness of Our marketing efforts, analyze broad demographic trends, and improve user experience.

2. How We Use Cookies and Web Beacons

We use cookies for a variety of reasons, including to (a) analyze the usage of Our Website, (b) provide a more personalized experience, (c) allow You to more easily log in to use Our Website, and (d) help make Your use of Our Website more efficient and more valuable by providing You with a customized experience and recognizing You when You return.

We may also employ web beacons or other technology for a variety of reasons, such as (a) allowing Us to know if a certain page was visited or whether an e-mail was opened or (b) allowing Us to advertise more efficiently by excluding our current Users from certain promotional messages.

You can set Your web browser to warn You about attempts to place cookies on Your computer, limit the type of cookies You allow, or refuse cookies altogether; however, You may not be able to use some or all of the features of Our Website if You refuse/disable cookies.

GOVOLOGY uses the following types of cookies:

(a) Security. We use security cookies to enable You to log in and access Our Website, protect Your Account against fraudulent logins by others, and help detect, fight, and protect against abuse or unauthorized usage of Your Account.

(b) Session State. We use session cookies to remember Your login details and to be able to process Your purchases of Our Services. These are deemed strictly necessary to the working of Our Website. If these are disabled, then various functionalities of Our Website will be broken.

(c) Analytics. We use analytics cookies, such as Google Analytics, to better understand how Our Website is being used in order to improve User experience. All User data generated is anonymous and not linked to personally identifiable information. 

3. How We Use the Information We Collect

GOVOLOGY may use the information We collect through Your use of Our Website in the following ways:

  • Providing, administering, and facilitating Your use of Our Website, including the display of customized content
  • Notifying You of new Services, features, promotions, enhancements, and updates, including updates to the Website, Terms of Use, and Privacy Policy
  • Marketing Our Services to You, including sending You offers, promotions information, newsletters, email campaigns, and communications regarding new or existing Services, contests, and/or sweepstakes
  • Resolving site problems, handling or responding to customer support questions and issues
  • Processing or fulfilling Your request(s) and/or order(s) for Services, information, or features
  • Enabling User-to-User communication and interaction and soliciting input and feedback to improve User experience
  • Managing Your Account preferences and establishing Your Profile and Registration Information
  • Monitoring the technical functioning of Our Website and network
  • Developing new Services, website content, or offerings

  • Troubleshooting errors or issues with any of the Services
  • Tracking purchases and usage information
  • Communicating with You concerning Your Account
  • Asking You to participate in surveys about Our Services

4. Third-Party Disclosure

We do not sell, trade, or otherwise transfer Your Personally Identifiable Information to outside parties unless We provide You with advance notice. This does not include Our collaborative partners who sponsor Our Services for their clients and website hosting partners and other parties who assist us in operating Our Website, conducting Our business, or serving Our Users, so long as those parties agree to keep this information confidential. We may also release information when its release is appropriate to comply with the law, enforce Our Website policies, or protect Our or Others’ rights, property, or safety.

(a) Our Collaborative Partners. If You are a client of one of Our collaborative partners, such as APEX Accelerators, MBDA, VBOC, or other organizations, and use a discount code when purchasing GOVOLOGY Services, Your Account Information and Course Information may be shared with the sponsoring partner. 

(b) Third-Party Service Providers. We may share Your information with third-party companies that perform services on Our behalf, including payment processing, order fulfillment, data analysis, marketing services, e-mail campaigns, hosting services, and customer service. While providing the services for Us, these companies may access Your personal information and are required to use it solely as directed by Us for the purpose of Our requested service. 

(c) Business Transfers, Sales, Mergers, or Divestitures. In the event that GOVOLOGY undergoes a business transition, such as a merger, acquisition, corporate divestiture or dissolution (including bankruptcy), or a sale of all or a portion of its assets, We may share, disclose, or transfer all of Your information, including personal information, to the successor organization in such transition.

(d) Promotions. We may share Your information in connection with any promotion You choose to participate in as necessary to administer, market, sponsor, or fulfill the promotion or as required by applicable laws, rules, or regulations or in accordance with the applicable rules of the promotion/sweepstakes You enter.

5. How We Keep Your Information Secure

GOVOLOGY takes commercially reasonable security measures to protect against unauthorized access to, or unauthorized alteration, disclosure, or destruction of, sensitive data that You share and We collect and store. These security measures may include practices such as keeping Your sensitive data on a secured server behind a firewall, transmitting sensitive information (such as a credit card number) entered on Our Website using secure socket layer technology (SSL), regular scanning of Our Website for security holes, known vulnerabilities, and malware, regular Website updates, internal reviews of Our data collection practices and platforms, as well as physical security measures to guard against unauthorized access to systems where We store Your information. 

Unfortunately, no system can be 100% secured, and We cannot guarantee that communications between You and GOVOLOGY or any information provided to Us in connection with Your use of Our Website will be free from unauthorized access by third parties. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of User information at any time. Your password is an essential component of Our security system. As such, it is Your responsibility to protect it. Do not share Your password with any third parties. If Your password has been compromised for any reason, You should change it immediately and contact support@govology.com with any concerns.

6. Your Choices Regarding the Use of Your Information

As previously mentioned, You can always choose not to provide certain information to Us, but You may not be able to use certain features of Our Website. If You do not wish to receive promotional communications from Us, You can opt out by following the unsubscribe instructions provided in the promotional communication You receive.

Please note that despite Your opt-out choice or indicated email preferences, We will still send You administrative messages regarding Our Services, including, for example, administrative confirmations, order confirmations, important updates regarding the Services, and notices regarding Our policies.

7. How to Access and Update Your Information

You may access and update Your information that GOVOLOGY collects and maintains by logging into Your Account and updating Your Account information. You may also submit a request to access and/or update Your information by sending an email to support@govology.com. 

8. Deleting Your Account

8.1. How to Delete Your Account. If You are a User of Our Website and wish to delete Your Account, please email support@govology.com with Your request. We will make commercially reasonable efforts to respond to Your request within 24 hours.

8.2. What Happens When Your Account is Deleted? Please be aware that even after Your Account is deleted, some of Your information may still remain visible to others, including but not limited to any information that has been (a) incorporated into other User’s content, comments, postings, submissions, including but not limited to Course comments; (b) copied, stored or disseminated by other Users; (c) shared or disseminated by You or others such as in a Public Posting; or (4) posted on a Third-Party Platform. Deleting Your Account will not remove the information collected and already put in aggregate form or information that cannot, in Our sole discretion, be removed without undue burden to GOVOLOGY. GOVOLOGY is not able and/or obligated to remove any of Your information from a Third Party Platform.

Moreover, please be aware that even after Your Account is deleted, Your information is not removed entirely from Our servers and may not be removed from the servers of the Third-Party Platform You use to access Our Website. We may retain backup copies of Your information, including personal information on Our servers or databases (and/or any authorized third-party servers or databases We use) to assist with legal obligations, resolve disputes, and enforce Our agreements. Such information may be disclosed according to this Privacy Policy regardless of whether Your Account is deleted. Moreover, any Third-Party Platform that You use to access Our Services may also retain backup copies of Your information even after Your Account is deleted, which may be used and/or disclosed in accordance with their privacy policy.

9. COPPA (Children Online Privacy Protection Act)

When it comes to the collection of personal information from children under the age of 13, the Children’s Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children’s privacy and safety online.

We do not market to children under the age of 13.

10. Fair Information Practices

The Fair Information Practices Principles form the backbone of privacy law in the United States, and the concepts they include have played a significant role in the development of data protection laws around the globe. Understanding the Fair Information Practices Principles and how they should be implemented is critical to complying with the various privacy laws that protect personal information.

In order to comply with Fair Information Practices, We will take the following responsive actions should a data breach occur: 

i) We will notify You via email within seven business days; 
ii) We agree to the Individual Redress Principle, which requires that individuals have the right to legally pursue enforceable rights against data collectors and processors who fail to adhere to the law. This principle requires that individuals have enforceable rights against data users and have recourse to courts or government agencies to investigate and/or prosecute non-compliance by data processors.

11. CAN SPAM Act

The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations.

We collect Your email address to:

i) Send information and respond to inquiries and other requests or questions;
ii)  Process orders and send information and updates pertaining to orders and
iii) Send You additional information related to Your product and/or service.

To be in accordance with CANSPAM, We agree to the following:

i)  Not use false or misleading subjects or email addresses;
ii)  Identify the message as an advertisement in some reasonable way;
iii) Include the physical address of Our business or site headquarters;
iv)  Honor opt-out/unsubscribe requests quickly, and
v) Allow Users to unsubscribe by using the link at the bottom of each email.

If at any time You would like to unsubscribe from receiving future emails, You can email us at support@govology.com or follow the instructions at the bottom of each email. We will promptly remove You from ALL correspondence.

12. Modifications to This Privacy Policy

From time to time, We may update this Privacy Policy to clarify Our practices or to reflect new or different privacy practices, such as when We add new features. If We make any material change, We will notify You using prominent means such as by email notice sent to the email address specified in Your Account or by posting a notice on Our Website. The modifications will become effective on the day they are posted unless stated otherwise.

Any notifications regarding changes posted on Our Website may be removed after 30 days. If You have not used Our Website within 30 days, please consult the top of this Privacy Policy to determine when this Privacy Policy was last revised, as there may be changes that have occurred since Your last visit.

If You continue to use Our Services after the effective date of any change, then such use will be deemed an acceptance of and an agreement to follow and be bound by the Privacy Policy as changed. The revised Privacy Policy supersedes all previous Privacy Policies. For this reason, We encourage You to review this Privacy Policy any time You use Our Website and recommend that You print out a copy for Your records.
